1. Acceptance of Terms
By accessing SkyRockit (the “Service”), you consent to be bound by these Terms. Updates occur with 30 days’ notice, and continued use signals acceptance.
2. Description of Service
SkyRockit is a cross-platform productivity application available via web, desktop (Electron), and Android. Two tiers exist:
- Free (Launchpad): Task management, My Day, Inbox, unlimited lists, areas, subtasks, recurring tasks, Kanban board, tags, priorities, reminders, and cloud sync.
- Pro (Orbit): Everything in Free, plus Notes, Calendar, Journal, Media Library, and priority support.
3. Account Registration
3.1 Eligibility
Users must be at least 13 years old (16 in the EEA).
3.2 Account Security
Users maintain credential confidentiality and are responsible for all account activity. Unauthorized use should be reported to info@myskyrockit.com immediately.
3.3 Account Information
Users must provide accurate information and keep it current.
4. Subscription Terms
4.1 Free Tier
No cost, no credit card required. Free tier includes full task management with cloud sync. Features may be modified with 30 days’ notice.
4.2 Pro Tier
- Monthly: $9.99 USD
- Annual: $79.99 USD per year
- Taxes added based on jurisdiction.
4.3 Free Trial
Standard trial is 14 days (promotional offers may extend this). No payment information required. Trial expiration transitions accounts to Free tier; no data deletion occurs. Pro features become read-only.
4.4 Billing and Renewal
Subscriptions renew automatically unless cancelled before the renewal date. Stripe processes payments.
4.5 Price Changes
Pricing modifications take effect at the next billing period following 30 days’ notice. Users may cancel before new prices apply.
4.6 Cancellation
Subscriptions may be cancelled anytime via Stripe Customer Portal or info@myskyrockit.com. Users retain Pro access through the current billing period; afterward, accounts transition to Free tier. Data remains accessible but read-only.
4.7 Refunds
- Annual subscriptions: Full refund within 30 days of initial purchase or renewal.
- Monthly subscriptions: Not eligible for refunds; users may cancel anytime.
- Promotional subscriptions: Follow underlying billing cycle terms.
4.8 Failed Payments
Stripe retries failed payments according to its schedule. Accounts marked “past due” receive email notification. After 7 days without resolution, accounts transition to Free tier.
4.9 Communications
Users receive transactional communications (required) and optional product/marketing communications. Marketing emails may be opted out via unsubscribe links, Settings, or info@myskyrockit.com. Legal bases include contract performance, legitimate interests, and consent.
5. User Content and Data Ownership
5.1 Your Content
Users retain full ownership of all User Content, including tasks, lists, notes, journal entries, calendar events, tags, and media files.
5.2 License to Operate
Users grant a limited, non-exclusive license to store, process, transmit, and display User Content for service provision, maintenance, and improvement.
5.3 Data Export
Users may export data in JSON format via Settings anytime.
5.4 Data Deletion
Account deletion removes all User Content and personal data within 30 days; backup copies persist for up to 30 additional days. Payment records retain per financial regulations.
6. Acceptable Use
Users agree to comply with the Acceptable Use Policy and applicable laws. Prohibited activities include unlawful use, unauthorized access, service interference, reverse engineering, automated access without consent, IP infringement, malware/spam distribution, and reselling or redistributing access.
7. Intellectual Property
7.1 Our Intellectual Property
SkyRockit, its logo, “Launchpad,” “Orbit,” and related marks are trademarks of Simoes Media. The Service’s design, code, features, and documentation are protected by intellectual property law. Trademark use requires written consent.
7.2 Feedback
Feedback grants an “unrestricted, perpetual, royalty-free license” for incorporation without obligation or compensation.
8. Service Modifications
8.1 Feature Changes
Features may be added, modified, or removed anytime. Material functionality reductions require 30 days’ advance notice.
8.2 Plan Changes
Free and Pro tier features may be modified with 30 days’ notice for reductions. Existing subscribers are grandfathered through their current billing period.
8.3 Service Availability
High availability is strived for but not guaranteed. Maintenance or unforeseen circumstances may cause temporary unavailability.
9. Third-Party Services
The Service integrates with:
- Supabase, Inc. (authentication, database, file storage)
- Stripe, Inc. (payment processing, subscription billing)
- Vercel, Inc. (web hosting)
- Google LLC (optional OAuth sign-in)
- ClickFunnels/Etison LLC (billing portal, checkout, contact management)
- Loops, Inc. (email communications, marketing automation)
Third-party services are governed by their respective terms and privacy policies. Simoes Media is not responsible for their practices or availability.
10. Limitation of Liability
10.1 Disclaimer of Warranties
“THE SERVICE IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ WITHOUT WARRANTIES” of any kind, including merchantability or fitness for purpose.
10.2 Limitation of Damages
Simoes Media is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
10.3 Liability Cap
Total aggregate liability is capped at either amounts paid in the preceding 12 months or CAD $100, whichever is greater.
10.4 Exceptions
Liability for death, personal injury from negligence, fraud, and non-excludable liabilities cannot be limited.
11. Indemnification
Users indemnify Simoes Media and its officers, directors, employees, and agents against claims, liabilities, damages, losses, and expenses arising from service use, Terms violation, or third-party rights violations.
12. Termination
12.1 Termination by You
Users may terminate anytime via Settings or info@myskyrockit.com. Active subscriptions continue until billing period end unless immediate cancellation is requested.
12.2 Termination by Us
Simoes Media may suspend or terminate without notice if users violate Terms, engage in fraud/illegal activity, or continued service is not commercially viable. Terminations without cause receive prorated refunds; terminations for cause do not.
12.3 Effect of Termination
Service access ceases immediately. Data is retained for 30 days for export (except illegal activity cases), then permanently deleted.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by Ontario provincial and Canadian federal law.
13.2 Informal Resolution
Disputes require 30 days of informal resolution attempts via info@myskyrockit.com first.
13.3 Jurisdiction
Unresolved disputes are submitted to Ontario courts’ exclusive jurisdiction.
13.4 Class Action Waiver
Disputes proceed only individually, not as class, consolidated, or representative actions.
14. General Provisions
14.1 Entire Agreement
These Terms, Privacy Policy, and Acceptable Use Policy constitute the entire agreement and supersede prior communications.
14.2 Severability
Invalid or unenforceable provisions do not affect remaining provisions.
14.3 Waiver
Non-enforcement of any provision does not constitute waiver.
14.4 Assignment
Users cannot assign rights without written consent; Simoes Media may assign without restriction.
14.5 Force Majeure
Simoes Media is not liable for failures from causes beyond reasonable control, including natural disasters, government acts, infrastructure failures, pandemics, or labor disputes.
14.6 Notices
Notices are sent to account email addresses; users remain responsible for keeping email current.
